Research article (journal)The decision of the German Federal Court of Justice in Sahyouni puts an end to a long-time judicial dispute concerning the internal recognition of a private divorce realized under Sharia law. Unfortunately, the judges miss the chance to motion for a more restrictive application of the dubious priority rule in Art. 5 para. 1 sentence 2 EGBGB. Instead, the Senate follows the questionable approach of the legislator to prefer German nationality over foreign citizenships. An obiter dictum about the jurisdiction of the ECJ raises questions about the intertwining of German and European law.
