Jewish and Islamic law have been handed down in history in various genres. On the Jewish side, responsa are particularly prominent next to the classical rabbinical literature. These responsa correspond with fatwas in the Islamic culture, which are equally popular and widespread. This project will compare, for the first time, discursive-performative strategies in Jewish and Islamic legal texts and pay close attention to the respective religious, cultural and sociohistorical contexts. As a result, similarities and differences between responsa and fatwas will emerge on a discursive performative Level.
